Coverage is No-Fault
Coverage under the Act is no fault. That means that you don’t have to prove that injuries, or an illness, were caused by someone’s fault. It doesn’t matter even if an accident or illness was due to your own fault, or nobody’s fault. If you were injured or became ill because of your job, you are entitled to benefits.
Defense Base Act Benefits
Medical care is provided for under the Act. You are entitled to full medical care, and to be treated by a doctor of your choice. You do not have to get medical care from a doctor appointed by your employer or its insurance carrier.
Disability Compensation
If you unable to work while you are recovering from your injuries or illness, you are entitled to temporary total disability benefits. The amount of benefits you are entitled to receive is generally 2/3's of your average weekly wage, before taxes, that you were earning at the time you were injured or became ill, subject to maximum limits.
Once you have recovered to the maximum extent medically possible, you may be entitled to further benefits, if you are permanently disabled.
